These ‘Terms & Conditions’ regulate access to and browsing of the www.topgim.com website, which is the responsibility of Topgim Ibrafer - Material Desportivo e Fitness, Unipessoal Lda, with its head office at Avenida 25 de Abril, Lote 86, in Sintra, hereinafter referred to as TOPGIM, by reference to the registered trade mark it owns.

Any legal issues relating to the site can be consulted on the Privacy Policy and Cookies Policy pages, which form an integral part of these ‘Terms & Conditions’.

The use of this site by any user will be governed by the following ‘Terms & Conditions’, which imply acceptance by the user. If the user rejects these ‘Terms & Conditions’, they must cease using the site.

TOPGIM may amend or update, in whole or in part, these ‘Terms and Conditions’, as well as the ‘Privacy Policy’ and the ‘Cookies Policy’. Any changes or updates to the aforementioned documents will come into force as soon as they are published in the relevant section of the website.

The product information presented on the site is intended only to provide a brief summary for the convenience and information of the visitor.

We endeavour to ensure that the information and data on the site is accurate and updated on a daily basis. However, updates and correctness are not guaranteed. We do not expressly or implicitly guarantee the accuracy or completeness of any information (including information relating to goods and services) included on the site.

We reserve the right to alter, remove or move any information on the site at any time without prior notice.

4.1 Online orders

The quickest and most effective way to place an order with us is always via our website.

How do I order from our online shop?

• Select the product(s) and add it to the basket and benefit from free postage over 99€; 😊
• Follow the checkout instructions to fill in the order details;
• Select your payment method;
• Confirm the order details;
• Complete the payment;
• The product(s) will be dispatched to the address provided.

4.2 Mail orders

If you do not wish to order via our website, you can send us an email to loja@topgim.com.

Main considerations below:

• You must provide your billing details, delivery address and a list of the products with our reference and their quantities;

• A PDF quotation will be sent to you before payment is made, in order to confirm that all the products included in the document correspond to what you want;
• The payment options for the PDF quote are as follows:
• Multibanco;
• MBWay;
• Bank transfer.
• The material will only be reserved once payment has been received;
• In the case of payment by bank transfer, please note that it may take 1-2 working days between payment by the customer and receipt of the amount in the bank account. During this period, stock variations may occur and an item may no longer be in stock when payment is received.

What does the guarantee cover?

1. Defective products or parts from the factory;
2. Damage caused during transport from our premises to the destination;
3. Any other point that is not described in the following points in the text ‘The guarantee does not cover’.

What does the guarantee not cover?

1. Products referred to as domestic range, used in sports or institutional spaces, as well as gyms, training academies, clubs or any other establishment for collective use;
2. Incorrect assembly, installation or damaged parts due to improper assembly;
3. Products or equipment in which the original parts have been replaced by others not supplied by the manufacturer;
4. Parts subject to wear and tear, such as: ropes, batteries, handles, bearings, springs, belts, pedals, pulleys, elastic bands, etc., after 6 months have elapsed since the product was purchased;
5. Anomalies caused by factors extrinsic to Topgim, such as: humidity, sweat, environments close to the sea, swimming pools, terraces, use of chemical products, etc;
6. Scratches, burns, falls to the ground or any other situation that demonstrates a lack of care.

TOPGIM accepts the following payment methods for online orders:

• MBWay
• Multibanco
• PayPal
• Klarna
• Credit Card
• Bank Transfer (only valid for Spain)

Payment must be processed correctly for the order to be processed automatically. If the payment is not processed correctly, the order will not be dispatched and a refund will be made.

For orders paid for by bank transfer, customers should send proof of payment to loja@topgim.com.

Unless otherwise stated, the content of the website, text, images, photographs are copyright of the company and their use is prohibited for commercial or other purposes.

The user is responsible for the content of the information sent or transmitted to the site.

The user is aware that the use of the site may not be 100% secure and there is a possibility that the information sent/received may be intercepted by unauthorised parties and the company will not be responsible for security breaches in communications and will not assume any responsibility for the use of their information by third parties.

The user recognises that access to and use of the site may be interrupted and that the information on the site may contain defects, errors, technical faults, problems and other limitations. The website may contain addresses to other websites or be accessed by other websites. The company is not responsible for these, in particular for content control, availability, operability or performance.

In the event of a breach of these ‘Terms & Conditions’, TOPGIM reserves the right to exercise any and all legal remedies. Furthermore, TOPGIM reserves the right, at our discretion, to terminate your access to or use of the site with or without notice.

The ‘Terms & Conditions’ for use of the site are governed by the laws in force. If any provision described herein is illegal, void or for any reason unenforceable, that provision shall be eliminated or reduced as provided by law, without affecting the validity and enforceability of the other provisions.

TOPGIM reserves the right to amend these ‘Terms & Conditions’ without notice. The user is bound by the version of the ‘Terms & Conditions’ in force at the time of use, so TOPGIM recommends that you check them periodically.

Any agreements and documents to which these conditions of sale apply shall be governed by Portuguese law. Disputes arising from any agreements or documents to which these conditions of sale apply shall be submitted to the competent courts of Portugal.
